“Security for businesses, security for human beings, security for people who have gone through so much,” said Sergio Jimenez, a street vending organizer with the nonprofit Community Power Collective in Los Angeles. “This law is a step toward ensuring that our vendors can work without fear.”

California’s street vendors, many of whom are immigrants, have often found themselves in precarious situations, especially as federal immigration enforcement has intensified under the Trump administration. The new law prohibits local authorities from requiring fingerprinting or disclosing personal information—such as names, addresses, and social security numbers—without a judicial subpoena.

Jessica Vaughan, director of policy studies at the Center for Immigration Studies, noted the stark divide in how states are responding to immigration issues. “We have seen some states move to cooperate to the greatest extent that they possibly can with Trump’s administration and others doing what they can to try to thwart immigration enforcement in their state,” she said.

As the nation grapples with immigration policy, California stands out as a beacon of protection for its immigrant population. The new law reflects a growing commitment to creating safe spaces for immigrants, particularly in light of recent federal actions that have reversed protections for sensitive locations like schools and hospitals.

Other Democratic-led states are following suit. Maryland has enacted laws restricting access for immigration enforcement in public schools and libraries, while Colorado has introduced civil penalties for institutions that collect information about individuals’ immigration status.

Conversely, Republican-led states have largely moved to bolster federal immigration policies. States like Texas and Florida have enacted laws requiring local law enforcement to cooperate with U.S. Immigration and Customs Enforcement (ICE), leading to a significant increase in state participation in federal immigration enforcement programs.
