The complaint, filed in Los Angeles Superior Court, targets New York Marine, QBE Insurance Group Limited, and Certain Underwriters at Lloyd’s, accusing them of breach of contract for denying coverage related to a lawsuit initiated by actress Blake Lively. Collectively, the insurance policies in question are valued at over $8 million.
Eight months into this multifaceted legal battle, Wayfarer has reportedly been footing the bill for Baldoni’s defense, as outlined in the complaint. The situation escalated earlier this month when Harco National Insurance, another insurer for the film, filed its own lawsuit against Wayfarer, claiming it has no obligation to cover legal fees due to alleged misconduct occurring during a period when the company was not insured.
In the latest filing, Wayfarer argues that the insurers have failed to uphold their responsibilities to defend against lawsuits alleging defamation and related claims. The insurance policies in question were designed to cover various forms of liability, including “personal and advertising injury” and “multimedia liability,” which encompass issues of invasion of privacy and defamation.
Despite being notified of Lively’s lawsuit in April, the insurers responded with denials of coverage. QBE acknowledged that the claims could potentially trigger coverage but cited undisclosed exclusions. Meanwhile, Lloyd’s contended that the allegations did not pertain to the content of Baldoni’s Man Enough podcast, which is central to Lively’s claims.
Wayfarer’s legal team, led by attorney Eliza Logan, argues that a thorough investigation by the insurers would have revealed the podcast’s relevance, as it is mentioned over 20 times in the context of Lively’s allegations. Although Lively’s lawsuit includes a claim for false light invasion of privacy, it notably does not allege defamation, focusing instead on how Baldoni’s public relations strategies allegedly undermined her reputation.
With Wayfarer now embroiled in litigation against its insurers, the legal landscape surrounding It Ends With Us has become increasingly convoluted. At least five lawsuits have been filed in connection with the film, with significant financial backing on both sides—Baldoni is supported by billionaire Steve Sarowitz, while Ryan Reynolds stands behind Lively.
Baldoni’s legal representation, led by Bryan Freedman, is known for its aggressive litigation tactics. In addition to the current lawsuits, Freedman has initiated a sister lawsuit against Wayfarer’s former publicist for breach of contract and has even subpoenaed Taylor Swift, alleging that she was the target of an extortion attempt linked to Lively.
